The attorneys behind two 2014 petitions to bring medical marijuana dispensaries to Costa Mesa are suing the city in an attempt to force a special election by month’s end that would allow voters to decide whether cannabis collectives come to town.

The lawsuits, filed Wednesday in Orange County Superior Court, come a day after Costa Mesa informally decided to kill a draft ordinance that would have permitted and regulated pot shops.

At issue in both lawsuits is whether Costa Mesa violated state election law when it decided not to hold a special election this month for the two cannabis initiatives and, instead, delayed the vote on the ballot measures until the November 2016 general election.
